Power Music :: Licensing Q&A

  Licensing Q&A

So you are interested in obtaining permission to use Power Music for your video production?
Many of our customers assume that since they've purchased a Power Music CD, it would be available to use as background music for their video production. This is a common misconception and the following information should clarify any questions you might have.

Q: Can I just use my Power Music tape as music in my video?

A: No, By law, one must obtain two licenses from two different sources for each song used on any video regardless of the nature of the video. The first license, the Master Use License, permits the use of the actual sound recording of a song. This is obtained from the company owning the master, which in most cases is the record company. The second license is called a Synchronization (Sync) License and is obtained from the publisher of the song. The publisher represents the composers and authors of the song, and the record company represents the artists and producers. This is why you cannot use a Power Music workout in your video. Power Music licenses the right to manufacture cassettes and CDs from the record company and publisher and not the rights to manufacture videos.

Q: So why can't I just go directly to the record companies and ask them for the right?

A: In almost all cases popular or original artist Top 40 songs cannot be licensed because 1) the record company and publisher simply do not license their material 2) it is cost prohibitive and 3) it could take months to obtain the proper licenses. Interests in less-popular songs from smaller record companies and publishers are also in most cases cost prohibitive. For example, the average cost for a less-popular song is $300-$1,000 for the Master and $300-$1,000 for the Sync License. That is $600-$2,000 per song. These prices are advance fees against future royalties of between $0.10-$0.20 per song per video sold.

Q: So where do I get video music?

A: As you can see this might be too much for the average Instructor to take on, so Power Music has come up with a low cost solution to this problem. Over the years our writers and producers have created hundreds of songs that are available for video license. Since we own the recordings and the compositions we can grant you the license to manufacture videos with music from our catalog. And with the advances in the Internet you can now preview preformatted workouts or build you own custom workouts right here with the click of a button. Music For Your Video.

Q: Are there any Power Music tapes and CDs in your brochures that I can use as is?

A: Yes, we have a few CDs that are controlled entirely by Power Music you can find this list when you visit  this link Preformatted Albums .  But if you are more interested in using some of our theme productions or our Top 40 CDs, you can license our remakes, but you will still have to contact the publishers of the compositions.  If this is the direction you would prefer, contact us and we will help you get started.
